Terms and Conditions

You must be at least 13 years old to use Crowdsnap. If you are under the age of majority where you live, a parent or legal guardian must authorize your use. Event hosts must be at least 18 and able to enter into a binding agreement. By creating an account, accessing an event, uploading content, or otherwise using Crowdsnap, you agree to these Terms and acknowledge our Privacy Policy.

You are responsible for information submitted through your account and for keeping sign-in methods, event links, QR codes, and event passwords secure. Access to an event link does not grant ownership of the event or its content and may be revoked at any time.

Hosts are solely responsible for their events, invitations, notices to attendees, and use of guest submissions. Hosts must obtain all permissions and consents required to record at the event and to collect, download, display, publish, or otherwise use submissions.

You represent and warrant that you own or control the rights needed to submit your content; have permission from people depicted or recorded where required; and that the content and our permitted use of it do not violate any law or any person's privacy, publicity, copyright, trademark, contractual, or other rights.

You retain your ownership rights. You grant Pyroblue a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, transmit, transcode, resize, analyze, moderate, create technical derivatives of, and display your content as reasonably necessary to operate, secure, support, and improve Crowdsnap, comply with law, and enforce these Terms. You also authorize the applicable event host to access, download, organize, display, and use submissions for the event-related purposes the host communicates to you.

You may not submit illegal, threatening, harassing, hateful, defamatory, exploitative, sexually explicit, non-consensual, or invasive content; sexualize or exploit minors; infringe intellectual property or privacy rights; impersonate others; distribute malware; scrape the service; evade limits; interfere with security or availability; or use Crowdsnap for unlawful surveillance.

Crowdsnap relies on third-party providers for hosting, authentication, storage, media processing, analytics, communications, and payments. Their services may be governed by separate terms and may become unavailable. Pyroblue is not responsible for third-party services or external links.

We may use automated tools and human review to detect nudity, abuse, unlawful material, or other policy violations. These efforts are not perfect, and Pyroblue does not undertake a duty to pre-screen or monitor all content. We may block, quarantine, remove, preserve, or disclose content; suspend accounts or events; and cooperate with authorities when reasonably necessary. Report concerns to apps@pyroblue.com.

Crowdsnap is provided on an "as is" and "as available" basis. Uploads, originals, derivatives, and generated clips may be unavailable, corrupted, removed, or deleted. You are responsible for independent backups. To the fullest extent permitted by law, Pyroblue disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

To the fullest extent permitted by law, Pyroblue and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, data, content, or event opportunities. Pyroblue's aggregate liability arising from Crowdsnap or these Terms will not exceed the greater of $100 or the amount you paid Pyroblue for Crowdsnap during the 12 months before the claim.

If you believe content on Crowdsnap infringes your copyright, email apps@pyroblue.com with your contact information, identification of the protected work and disputed material, its location, a good-faith statement, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your physical or electronic signature. Knowingly false notices may create liability.

Features may be offered free during an early-access pilot and may later require payment or have usage limits. If paid plans are enabled, the pricing and billing terms shown at checkout will apply. Unless required by law or expressly stated otherwise, fees are non-refundable.

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Pyroblue, its affiliates, and their officers, employees, contractors, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your content; your event, invitations, or use of submissions; your use or misuse of Crowdsnap; your violation of these Terms or law; or your infringement of another person's rights.

Colorado law governs these Terms without regard to conflict-of-law principles. Any dispute not resolved informally must be brought exclusively in an appropriate state or federal court located in Colorado, and each party consents to personal jurisdiction there.

To the fullest extent permitted by law, you and Pyroblue knowingly and irrevocably waive any right to a trial by jury in any dispute arising from Crowdsnap or these Terms.

These Terms and the Privacy Policy are the entire agreement concerning Crowdsnap. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Pyroblue may assign them in connection with a reorganization, financing, or transfer of the service. We are not liable for delays caused by events beyond our reasonable control.

We may update these Terms by posting a revised version and effective date. Material changes may require renewed acceptance. We may suspend or terminate access, remove content, or discontinue features when necessary to enforce these Terms, protect users, manage risk, or comply with law.
